This is the purpose of the open letter by which a journalist journalist, called the public prosecutor, on the NUBUEKE file, a movement under judicial harassment for his support of the democratic struggle. Mr. Prosecutor, two questions have always tapped my mind, as a litigant. But the opportunity never came for me to ask you. Or to be more honest, I have always been afraid to approach you to ask them, for fear of not being able to leave your offices without charge. But today, I take my courage in both hands as we say it trivially home, to ask you, whatever by letter. My questions are: Is it permissible for a citizen to question you? Can we contradict you without taking a few months or years of prison? I would like the answers to be positive, that is to say, "YES, go ahead, young brother". I read in the press, a few days ago, your press release concerning the arrest and imprisonment of the three members of the NUBUEKE citizen movement of which I am a member. I admit to having had all the trouble of recognizing the movement you have painted. He is anything but NUBUEKE.

Against them, you carry heavy charges such as "criminal conspiracy", "incitement to revolt", "illegal possession of military equipment", etc. Mr. Prosecutor, the rope seems too big. NUBUEKE is nothing like your description of it. On the contrary, it is a group of BIENFAITORS who has proven it more than once in the field. As an example, just a year ago, the movement traveled all over Togo, with the few resources at its disposal, to make our compatriots aware of decentralization, its challenges and challenges. Similarly, NUBUEKE organized a "CHU Sylvanus Olympio clean" operation last year, on its own initiative and at its own expense. Mr. Prosecutor, do you know the criminals capable of all these charitable works? Believe it or not, NUBUEKE has no ounce of violence in him. Rather than chastising the movement, you should congratulate it and encourage it to continue its mass education activities. It is therefore unjust the fate reserved to the three members of the movement by you.

You say you have evidence of their guilt. These proofs, sir, appear to us too light to constitute the basis of such grave accusations. If you allow, let's analyze your exhibits a bit. A pair of binoculars ??? Even children have some to contemplate nature. We see it everywhere in the world. Why should this be a crime in Togo? Cases of tear gas grenades ??? We all got home in memory of those days when we were gassed during the demonstrations. In addition, these cases are found everywhere in Lomé where the police fired tear gas to disperse the demonstrators. If it's a crime to pick them up, then trust me, prosecutor, you will not have any more room in the jail for anyone who brought it home.

However, I would have acclaimed you if it were real teargas grenades found at Mr. Kokodoko's, and not mere cases representing a priori no danger to anyone. I would have even asked the movement for an explanation, because NUBUEKE was never asked to fight any violent struggle. And believe me, I would have left the movement in a crash, because I do not find myself in such an ideology. But simple cases ??? The string seems really too big, sir.

For this reason, Mr. Prosecutor, you should not only review the case of these defendants and release them, but also, you should open an investigation to shed light on the allegations of torture and inhuman and degrading treatment they have suffered. These facts are quite serious and deserve to be elucidated, because we do not tolerate being treated like animals, even though the animals have rights. You should therefore conduct an investigation very quickly and punish with the utmost rigor the perpetrators of these barbarous and despicable acts that our country no longer wants.

Mr. Prosecutor, if I dared to challenge you, it is because I took care to do what any magistrate does when he must do justice: the investigation! An inquiry about you to find out if my company had a chance to prosper, that is to say, to find a listening ear with you. I did it also for the sake of justice. I did not want to overwhelm you unfairly, for what you are not, or for what you do not do of your own free will. Sense of justice obliges.

The ones I interviewed are mostly your former university colleagues and people who rubbed you at some point in your life. So people who know you more or less well; in any case better than me. Some have become lawyers, others are renowned lawyers. All reassured me that you are an open-minded man, open to debate and criticism (we do not expect better from a high magistrate like you). They claim that as a student, you were a brilliant, honest, loyal, fair man, with good human qualities. And speaking of the human, someone even confided to me that without knowing you neither Adam nor Eve, you helped him one day to get away from a big personal problem, whereas nothing you obliged. In short, that good on you.



However, the same people who cover you with compliments admit not to recognize their comrade Essolizam face certain situations, especially in the exercise of your duties. Those who are lawyers tell me they have a hard time understanding you when they plead in your courtroom or when they become aware of your decisions. Because there is a stark contrast between your decisions and your true personality. Maybe they exaggerate? But I want to discover the Essolizam that I was presented with as much praise. Will you do me that honor? I assume so, yes. So, you have the opportunity in this file to show your younger brother (me) that you really are the person we talked to.

That's why, Mr. Prosecutor, I ask you, to reconsider the file of the three members of NUBUEKE and release them. Because they do not serve you in prison. They are rather useful when they go to their professional occupations for the development of our country. These are people whose skills are proven and recognized in their different fields. Do not destroy their career by mistake. Do not make their children unhappy little ones who will grow up with a hatred of our justice and men, and worst of all, towards society as a whole. Do not make their women feel guilty about not being able to protect their husbands. Do not make the NUBUEKE members feel this feeling of ingratitude from the nation towards them, despite the priceless work they have done during these two years for the country. Do not make me regret my commitment to bring light to my compatriots. You will render a service to the Togolese nation, which is passing through sensitive times, by freeing these three brave citizens. They do not have their place in prison. Finally, as I told you at the beginning of my letter, I know that it is risky to dare what I just dared to do. In doing so, I was not unaware of the prosecution you could bring against me, especially for "contempt of court", but my passion for justice and love of the homeland have taken precedence over fear. However, if you want to make me pay for my daring, I will assume. That is why I borrow from the famous Emile Zola these words of his famous open letter "J'accuse" to tell you, "dare to bring me to the Assize Court and that the investigation takes place in broad daylight !
